eliteclub® , and all of its subsidiaries and affiliates, including Plan B Solutions DMCC, which provides the Services to you (“eliteclub®,” “we,” “our,” or “us”) provides Loyalty Program, Rewards Program, Hotel Privilege Memberships and other services to users around the world. Please read our Terms of Service to have a better understanding of the eliteclub®.
You agree to our Terms of Service (“Terms”) by installing, accessing, or using our apps, services, features, software, or website (together, “Services”).
About our services and general Terms & Conditions:
Registration: You must register for our Services using accurate data, provide your name, valid e-mail address and current mobile phone number, and, if you change it, update this email and mobile phone number using our in-app Update My Account feature.
You agree to receive text messages and automatic emails (from us or our third-party providers) with codes to register for our services or to welcome you as a member.
Age: You must be at least 18 years old to use our services (or such greater age required in your country for you to be authorized to use our services without parental approval). In addition to being of the minimum required age to use our services under applicable law, if you are not old enough to have authority to agree to our terms in your country, your parent or guardian must agree to our terms on your behalf.
Devices and Software: You must provide certain devices, software, and data connections to use our services, which we otherwise do not supply. For as long as you use our services, you consent to downloading and installing updates to our Services, including automatically.
Fees and Taxes: You are responsible for all carrier data plans and other fees and taxes associated with your use of our Services. We may charge you for our Services, including applicable taxes. We may refuse or cancel orders. We do not provide refunds for our Services, except as required by law.
Membership: You are aware that a Membership is valid for 12 months from the date of issue / Membership has no cash value and does not guarantee a dining reservation nor a Hotel Booking.
Membership, Membership cards and online cards are non-transferable and may only be used by the Member.
Membership accounts and cards are the property of eliteclub® and a fee may be charged for replacing lost or damaged cards.
Where printed Membership cards are provided, all lost or stolen Membership cards will not be replaced and must be reported to eliteclub® by calling us at +971 800 eliteclub (+971 800 354832582) or write to us via P.O.Box at: 337132 Dubai – UAE or Live Chat Service through eliteclub® websites or mobile apps. A processing fee of forty U.S. Dollars (40 USD) or an equivalent amount in your local currency will be charged (depending on the membership country purchased) and will be issued with the same expiration date as the previously issued card.
Members are requested to identify themselves as eliteclub® Members at the time of advance reservation or when using the Services. e-Vouchers are valid for 12 months from the date of issue and validity will not be extended beyond the expiration date.
Benefits may be subject to change without prior notice. Wherever possible, members will be kept updated on all such modifications. Members can also verify outlets participation & benefits through eliteclub® App, Website or by contacting our live chat customer service department. Membership Program marketing agent declines any responsibility for any such modifications.
Black-out Dates: All benefits are subject to availability, valid seven days a week, excluding black-out dates, and may not be used in conjunction with any other discounts or promotional offers.
All benefits shall not be extended on the following Black-out Dates: Palm Sunday, Easter Sunday, Mother’s Day, Valentine’s Day, Christmas Eve, Christmas Day, New Year’s Eve and Day, Eid El-Fitr, Eid El-Adha.
Limitation of liability: In no event shall the owners, operators, franchisors or licensors of any hotel that may accept the benefits of membership herein, or any of their affiliated or subsidiary companies, or their directors, agents, managers, or employees, or the proprietor or the marketing agent of the Membership Program (hereinafter collectively “Protected Parties”) be liable for any indirect, special or consequential damages; and without limiting the generality thereof, including any loss, cost or damage to, or suffered by, the Member or others, arising from defects, negligence, delays, failure of performance or non-performance, including all claims, demands, obligations, liabilities, indebtedness, breaches of contract, breaches of duty or of any relationship, liability for acts, omissions, misfeasance, malfeasance, damages of every type, nature or kind suffered by Members or others, resulting from the action, or inaction of the hotel or its agents or employees in connection with the Benefits provided to Member herein. In the event of a breach of any of the provisions hereof by any Protected Party, the extent of any liability of any such Protected Party shall be limited to the amounts paid by Member as a subscription for membership in eliteclub® during the last 12 Months.
Any dispute or claim arising out or in connection with our digital properties www.eliteclub.global; www.eliteclubhotels.com; www.pbsgalaxy.com; www.pbsloyalty.com; and the eliteclub® App listed by Plan B Solutions on Google Play and App Store shall be governed and constructed by arbitration in accordance with the provisions set forth under DIAC Arbitration Rules by one or more arbitrators appointed in compliance with the Rules and English Language.
MEMBERSHIP, ENROLMENT & TERMINATION:
Membership enrolment can be made online at our digital properties www.eliteclub.global; www.eliteclubhotels.com; www.pbsgalaxy.com; www.pbsloyalty.com; and the eliteclub® App listed by Plan B Solutions on Google Play and App Store or directly at our offices or partners locations by completing an enrolment form. Upon enrolment, members may use the membership number and benefits issued to them to make use of the program.
Payment of the full membership fee must be done in the applicable local currency or currency available on our third party payment providers.
Online payments will be done by using Visa and MasterCard credit/debit card in AED, USD, EUR, SAR, OMN and the cardholder must retain a copy of transaction records and merchant policies and rules. The details you are asked to submit will be provided directly to our payment provider via a secured connection.
A Member may only hold one membership account at any time. If a member creates a duplicate account, eliteclub® reserves the right to merge and consolidate the details of the member into the member’s earlier account. eliteclub® is not responsible for any loss of member benefits and/or services due to duplicate membership.
Cancellation Policy: Cancellation of membership will be honored up to five (5) working days from the date of issue, but no refund will be issued in case membership has been used.
Refunded amount will be excluding handling charges fee of forty U.S. Dollars (40 USD) or an equivalent amount in your local currency and will be done only through the Original Mode of Payment.
If a Member has obtained eliteclub® membership through fraud, dishonesty or deceit, or has abused eliteclub® benefits or committed other misconduct, then the Member shall, without limitation, be liable to eliteclub®, participating hotels, participating outlets or partners for the full price of the products or services obtained together with all costs and damages incurred or suffered by eliteclub®, participating hotels, participating outlets or partners as a result thereof.
Privacy policy and user data
eliteclub® cares about your privacy. eliteclub® privacy policy describes our information practices, including the types of information we receive and collect from you and how we use and share this information. You agree to our data practices, including the collection, use, processing, and sharing of your information as described in our privacy policy, and you acknowledge that the laws, regulations, and standards of the country in which your information is stored or processed may be different from those of your own country.
Use of our services
Our Terms and Policies. You must use our services according to our terms and posted policies. , such as the unauthorized utilization of another individual’s personal information and credit card for the purpose of establishing a membership account, or the unauthorized resale of App products for personal profit, you will not create another account without our permission.
Legal and Acceptable Use: You must access and use our services only for legal, authorized, and acceptable purposes. You will not use (or assist others in using) our services in ways that: (a) violate, misappropriate, or infringe the rights of eliteclub®, our partners or integrated services, participating hotels and outlets, or others, including privacy, publicity, intellectual property, or other proprietary rights; (b) involve any non-personal use of our Services unless otherwise authorized by us.
Harm to eliteclub® or our users: You must not (or assist others to) access, use, copy, adapt, modify, prepare derivative works based upon, distribute, license, sublicense, transfer, display, perform, or otherwise exploit our services in impermissible or unauthorized manners, or in ways that burden, impair, or harm us, our services, systems, our users, or others, including that you must not directly or through automated means: (a) reverse engineer, alter, modify, create derivative works from, decompile, or extract code from our services; (b) send, store, or transmit viruses or other harmful computer code through or onto our Services; (c) gain or attempt to gain unauthorized access to our services or systems; (d) interfere with or disrupt the integrity or performance of our services; (e) create accounts for our services through unauthorized or automated means; (f) collect the information of or about our users in any impermissible or unauthorized manner; (g) sell, resell, rent, or charge for our services; or (h) distribute or make our services available over a network where they could be used by multiple devices at the same time.
Keeping your account secure. You are responsible for keeping your device and your eliteclub® account safe and secure, and you must notify us promptly through e-mail [email protected] of any unauthorized use or security breach of your account or
Third-party services
Our services may allow you to access, use, or interact with third-party websites, apps, content, and other products and services. For example, you may choose to use third-party features (such as login with Facebook or ask for a ride with Uber) that are integrated with our services or interact with a share button on a third party’s website that enables you to send information to your contacts.
Indemnification
You agree to defend, indemnify, and hold harmless the eliteclub® parties from and against all liabilities, damages, losses, and expenses of any kind (including reasonable legal fees and costs) relating to, arising out of, or in any way in connection with any of the following: (a) your access to or use of our services, including information provided in connection therewith; (b) your breach or alleged breach of our Terms; or (c) any misrepresentation made by you. You will cooperate as fully as required by us in the defense or settlement of any claim.
Availability and termination of our services:
Availability of our services: Our services may be interrupted, including maintenance, repairs, upgrades, or network or equipment failures. We may discontinue some or all of our services, including certain features and the support for certain devices and platforms, at any time. Events beyond our control may affect our services, such as events in nature and other force majeure events.
Termination: We may modify, suspend, or terminate your access to or use of our services anytime for any reason, such as if you violate the letter or spirit of our terms or create harm, risk, or possible legal exposure for us, our users, or others. The following provisions will survive any termination of your relationship with eliteclub®: ” “Disclaimers,” “Limitation of Liability,” “Indemnification,” “Dispute Resolution,” “Availability and Termination of our Services,” “Other”.
Other
This terms of service and their interpretation are subject to Dubai-UAE Law. All parties agree to resolve all disputes in an amicable negotiation. If parties fail to reach an agreement using the way mentioned above, the dispute shall be resolved by arbitration in accordance with the provisions set forth under DIAC Arbitration Rules by one or more arbitrators appointed in compliance with the Rules and English language.
